摘 要
随着城市化进程的加速,社区物业管理逐渐成为社会治理的重要组成部分,而业主委员会作为连接居民与物业企业的关键纽带,在社区治理中发挥着不可替代的作用然而,当前业主委员会在实际运作中面临诸多困境,如法律地位模糊、组织能力不足、权力监督缺失以及与物业企业及政府之间的协调不畅等问题,这些问题严重制约了其功能的有效发挥本研究以我国多个典型城市为案例,通过问卷调查、深度访谈和文献分析相结合的方法,系统探讨了业主委员会在社区物业治理中的现状、问题及其成因研究发现,业主委员会的困境主要源于制度设计的不完善、利益相关方的博弈以及社会参与意识的薄弱基于此,本文提出了一系列突破路径,包括明确业主委员会的法律地位、优化内部治理结构、强化外部支持体系以及构建多方协同治理机制等这些措施旨在提升业主委员会的自治能力和治理效能此外,本研究创新性地引入了“社区社会资本”概念,从社会关系网络的角度重新审视业主委员会的功能定位,并提出了增强社区凝聚力的具体策略最终,本研究不仅为解决业主委员会面临的现实难题提供了理论依据和实践指导,还对推动社区治理体系现代化具有重要意义

Abstract
With the acceleration of urbanization, community property management has gradually become an essential component of social governance, and the owners' committee, as a critical link between residents and property enterprises, plays an irreplaceable role in community governance. However, the current operation of owners' committees faces numerous challenges, such as ambiguous legal status, insufficient organizational capacity, lack of power supervision, and poor coordination with property enterprises and the government, all of which severely constrain their effective functioning. This study takes several typical cities in China as case examples and employs a combination of questionnaire surveys, in-depth interviews, and literature analysis to systematically explore the current status, problems, and causes related to the role of owners' committees in community property governance. The findings indicate that the difficulties faced by owners' committees primarily stem from imperfect institutional design, stakeholder博弈s, and weak social participation awareness. Based on these insights, this paper proposes a series of breakthrough strategies, including clarifying the legal status of owners' committees, optimizing internal governance structures, strengthening external support systems, and establishing multi-party collaborative governance mechanisms. These measures aim to enhance the self-governance capabilities and governance efficiency of owners' committees. Furthermore, this study innovatively introduces the concept of "community social capital" and re-examines the functional positioning of owners' committees from the perspective of social relationship networks, proposing specific strategies to strengthen community cohesion. Ultimately, this research not only provides theoretical foundations and practical guidance for addressing the real-world challenges faced by owners' committees but also holds significant implications for advancing the modernization of community governance systems.
