摘要
食品安全问题关系到公众健康与社会稳定,随着食品产业链的复杂化和全球化进程加速,传统监管模式面临诸多挑战。本研究聚焦于《食品安全法》中的消费者保护原则,旨在探讨其内涵、实践路径及制度完善。通过对国内外相关法律法规进行比较分析,并结合我国司法案例统计研究,发现现行法律在消费者权益保护方面存在预防性不足、救济机制不完善等问题。本文创新性地提出构建以风险预防为核心,涵盖事前准入、过程控制、事后救济的全链条保护体系,强调经营者信息透明义务与消费者知情权的平衡。研究结果表明,通过优化行政监管机制、强化企业主体责任、完善公益诉讼制度等多维度综合治理措施,能够有效提升消费者权益保护水平。本研究为完善我国食品安全法制建设提供了理论依据,对推动食品安全治理现代化具有重要现实意义,同时为相关领域立法提供了有益参考。

Abstract
Food safety issues are closely related to public health and social stability. As the food industry chain becomes more complex and globalization accelerates, traditional regulatory models face numerous challenges. This study focuses on the consumer protection principle in the Food Safety Law, aiming to explore its connotations, practical approaches, and institutional improvements. By conducting a comparative analysis of relevant domestic and international laws and regulations, combined with statistical studies of judicial cases in China, it is found that the current legal fr amework falls short in preventive measures and remedial mechanisms concerning consumer rights protection. Innovatively, this paper proposes the establishment of a comprehensive protection system centered on risk prevention, encompassing pre-market access, process control, and post-incident relief. It emphasizes the balance between operators' obligation for information transparency and consumers' right to be informed. The research findings indicate that optimizing administrative supervision mechanisms, strengthening corporate primary responsibility, and improving public interest litigation systems, among other multidimensional integrated governance measures, can effectively enhance the level of consumer rights protection. This study provides theoretical support for improving China’s food safety legal system and holds significant practical implications for advancing the modernization of food safety governance. Additionally, it offers valuable references for legislation in related fields.

Abstract
