摘要
随着市场经济的发展和消费模式的多样化,消费者权益保护面临新的挑战,其中知情权作为消费者基本权利之一,在保障消费者利益方面具有不可替代的作用。本研究旨在探讨消费者权益保护法中知情权的保障机制及其实现路径,基于对国内外相关法律法规、政策文件以及学术研究成果的系统梳理,结合案例分析与比较研究的方法,深入剖析我国现行法律框架下知情权保障存在的问题,如信息不对称现象依然严重、经营者信息披露义务不明确等。通过构建以强化经营者责任为核心,完善信息披露制度为关键,引入第三方监督评价机制为补充的多维度保障体系,提出从立法层面细化知情权内容,加强执法力度确保法律规定有效执行,利用信息技术创新信息披露方式等实现路径,研究结果表明该保障体系与实现路径有助于提升消费者知情权的保障水平,增强消费者权益保护的有效性,本研究创新性地将第三方监督评价机制纳入知情权保障体系,并强调了信息技术在信息披露中的应用价值,为完善我国消费者权益保护法提供了理论参考与实践指导。

Abstract
With the development of the market economy and the diversification of consumption patterns, consumer rights protection faces new challenges. Among these, the right to be informed, as one of the fundamental rights of consumers, plays an irreplaceable role in safeguarding consumer interests. This study aims to explore the mechanisms and pathways for ensuring the right to be informed within consumer protection laws. By systematically reviewing relevant domestic and international laws, policies, and academic research, and employing case analysis and comparative studies, this paper delves into the issues present in China’s current legal fr amework concerning the protection of the right to be informed, such as severe information asymmetry and unclear obligations for operators regarding information disclosure. The study proposes a multidimensional safeguard system centered on strengthening the responsibilities of operators, with improving information disclosure systems as the key component, and supplemented by introducing third-party supervision and evaluation mechanisms. It suggests refining the content of the right to be informed at the legislative level, enhancing law enforcement to ensure effective implementation of regulations, and utilizing information technology to innovate information disclosure methods. The findings indicate that this safeguard system and its implementation pathways can enhance the protection level of consumers’ right to be informed and strengthen the effectiveness of consumer rights protection. Innovatively, this study incorporates third-party supervision and evaluation mechanisms into the safeguard system for the right to be informed and underscores the application value of information technology in information disclosure, providing theoretical references and practical guidance for improving China’s consumer rights protection laws.
