摘 要
食品安全法律标准的制定是保障公众健康、维护市场秩序的重要基石，随着全球化进程加快和食品产业链日益复杂化，传统立法模式面临诸多挑战。本文旨在探讨当前食品安全法律标准制定过程中存在的问题并提出针对性解决方案，通过文献研究法、比较分析法以及案例研究法，系统梳理国内外相关法律法规及政策文件，剖析现行制度在覆盖范围、执行力度、协调性等方面的不足。研究发现，现有法规存在更新滞后、部门间协作机制不畅、对新兴风险预判能力欠缺等问题。为此，本文创新性地提出构建以风险评估为核心、多部门协同治理为支撑、公众参与为补充的新型法律框架体系，强调全过程监管与动态调整机制的重要性。该研究不仅填补了国内关于食品安全法律标准体系优化路径的理论空白，还为相关政策制定者提供了具有可操作性的建议，对于提升我国食品安全治理水平具有重要现实意义。

Abstract
The establishment of food safety legal standards is a critical foundation for protecting public health and maintaining market order. As globalization accelerates and the food industry supply chain becomes increasingly complex, traditional legislative models face numerous challenges. This paper aims to explore the existing problems in the current process of formulating food safety legal standards and propose targeted solutions. Through the use of literature review, comparative analysis, and case studies, this research systematically examines relevant laws, regulations, and policy documents both domestically and internationally, analyzing deficiencies in the current system regarding coverage, enforcement intensity, and coordination. The study finds that existing regulations suffer from delays in updates, inadequate inter-departmental collaboration mechanisms, and insufficient predictive capabilities for emerging risks. To address these issues, this paper innovatively proposes constructing a new legal fr amework system centered on risk assessment, supported by multi-department collaborative governance, and supplemented by public participation. It emphasizes the importance of comprehensive process supervision and dynamic adjustment mechanisms. This research not only fills the theoretical gap in optimizing the food safety legal standard system in China but also provides actionable recommendations for policymakers, significantly contributing to enhancing the country's food safety governance level.
