摘 要
社区矫正是我国刑事执行制度的重要组成部分，随着《中华人民共和国社区矫正法》的颁布实施，社区矫正工作进入规范化发展阶段。然而在实际运行中仍存在诸多问题亟待解决，本研究旨在深入剖析社区矫正法律实施过程中的困境并探索有效路径。通过对全国12个省份36个社区矫正机构实地调研，结合对500余名社区矫正对象、工作人员问卷调查及访谈，发现当前主要存在法律法规衔接不畅、部门协作机制不完善、社会力量参与不足、监管措施缺乏灵活性等问题。基于此，提出构建以法治化为基础，以信息化为支撑，以社会化为导向的“三位一体”社区矫正新模式，强调加强立法解释与配套法规建设，优化多部门协同治理格局，拓宽社会资源引入渠道，创新监督管理方式方法。该模式不仅为破解社区矫正实践难题提供了新思路，也为推进我国非监禁刑罚执行体系现代化贡献了理论参考，具有重要的现实意义和应用价值。

Abstract
Community correction is an integral component of China's criminal execution system. With the promulgation and implementation of the "Community Correction Law of the People's Republic of China," community correction work has entered a phase of standardized development. However, numerous challenges remain in practical operation that require urgent attention. This study aims to thoroughly analyze the difficulties encountered during the implementation of community correction laws and explore effective solutions. Through field research at 36 community correction institutions across 12 provinces, combined with surveys and interviews involving over 500 community correction subjects and staff members, it was found that the main issues currently include inadequate connection between laws and regulations, imperfect interdepartmental collaboration mechanisms, insufficient participation of social forces, and a lack of flexibility in supervisory measures. Based on these findings, this study proposes a new "trinity" model of community correction, which is grounded in legalisation, supported by informatisation, and oriented towards socialisation. It emphasizes strengthening legislative interpretation and supporting regulations, optimizing multi-department collaborative governance structures, broadening channels for introducing social resources, and innovating supervision methods. This model not only provides new perspectives for addressing practical challenges in community correction but also contributes theoretical references for advancing the modernization of China’s non-custodial penal execution system, thereby possessing significant practical implications and application value.
