摘 要
随着环境问题日益严峻，公众参与成为环境治理不可或缺的重要环节。本研究聚焦环境法律中的公众参与机制构建，旨在探讨当前机制存在的问题并提出针对性对策。通过对国内外相关文献的系统梳理与分析，结合我国实际情况，运用案例分析、比较研究等方法，深入剖析了现行公众参与机制在立法层面缺乏系统性规定、实施过程中透明度不足以及公众环境意识参差不齐等问题。研究发现，现有机制未能有效调动公众积极性，且在信息获取、决策参与等方面存在诸多障碍。为此，本文创新性地提出了构建多层次、多渠道的公众参与体系，强调完善法律法规保障，建立信息公开平台，优化参与流程设计，并通过教育宣传提升公众环境素养。该研究不仅为完善我国环境法律提供了理论支持，更为推动环境治理现代化进程贡献了实践路径，对于促进环境法治建设具有重要意义。

Abstract
As environmental issues become increasingly severe, public participation has emerged as an indispensable component of environmental governance. This study focuses on the construction of public participation mechanisms within environmental law, aiming to identify existing problems and propose targeted solutions. Through a systematic review and analysis of relevant domestic and international literature, combined with China's specific circumstances, this research employs case studies and comparative analysis to delve into current deficiencies in public participation mechanisms. These deficiencies include a lack of systematic legislative provisions, insufficient transparency in implementation, and uneven levels of public environmental awareness. The study reveals that existing mechanisms fail to effectively engage the public, presenting numerous obstacles in information access and decision-making participation. In response, this paper innovatively proposes the establishment of a multi-level, multi-channel public participation system, emphasizing the improvement of legal fr ameworks, the creation of information disclosure platforms, optimization of participation procedures, and enhancement of public environmental literacy through education and publicity. This research not only provides theoretical support for refining China’s environmental laws but also contributes practical pathways to advancing the modernization of environmental governance, thereby significantly promoting the development of environmental rule of law.
