摘 要
随着环境问题日益严峻，环境保护法律中的公众参与成为实现可持续发展的重要环节。本研究旨在探讨中国现行环境保护法律框架下公众参与的现状、问题与对策，通过文献分析、案例研究和实地调研相结合的方法，系统梳理了当前公众参与在环境决策、监督执行等环节存在的制度缺失、信息不对称、参与渠道不畅等问题。研究发现，公众参与意识虽逐步增强，但实际参与度仍较低，且缺乏有效的激励机制。为此，本文提出完善立法保障、构建多元化的参与平台、加强信息公开透明度、建立公众意见反馈机制等创新性建议，并强调应将公众参与纳入环境影响评价体系，形成政府主导、社会协同、公众参与的良性互动格局，以提升环境治理效能。该研究为完善我国环境保护法律体系提供了理论支持，对推动生态文明建设具有重要现实意义。

Abstract
As environmental challenges become increasingly severe, public participation in environmental protection laws has emerged as a critical component for achieving sustainable development. This study aims to examine the current status, issues, and strategies of public participation within China’s existing environmental protection legal fr amework. By integrating literature analysis, case studies, and field research, this paper systematically reviews the institutional deficiencies, information asymmetry, and inadequate participation channels that exist in environmental decision-making and enforcement supervision. The findings indicate that although public awareness of participation is gradually increasing, actual participation rates remain low due to the lack of effective incentive mechanisms. To address these issues, this paper proposes innovative recommendations such as improving legislative safeguards, establishing diversified participation platforms, enhancing transparency in information disclosure, and instituting public feedback mechanisms. It also emphasizes the importance of incorporating public participation into the environmental impact assessment system to foster a positive interactive pattern characterized by government leadership, social collaboration, and public involvement. This research provides theoretical support for refining China’s environmental protection legal system and holds significant practical implications for advancing ecological civilization construction.
