摘 要
随着市场经济的快速发展，行业垄断现象日益凸显，对市场公平竞争环境造成严重威胁，基于此背景探讨反垄断法律框架下的行业监管问题与对策具有重要意义。本研究旨在深入剖析反垄断法律框架下行业监管面临的挑战，通过文献研究法梳理国内外相关理论成果，运用案例分析法选取典型行业进行深入剖析。研究发现，当前行业监管存在法律法规不够完善、监管机构独立性不足、监管手段滞后等问题。针对这些问题提出创新性的对策建议，包括完善法律法规体系，细化反垄断法在各行业的适用规则；增强监管机构独立性，构建多部门协同监管机制；创新监管手段，利用大数据等现代信息技术提升监管效率。本研究不仅为解决我国行业监管现存问题提供了思路，还从理论上丰富了反垄断法律框架下行业监管的研究内容，对维护市场公平竞争秩序、促进市场经济健康发展有着积极的推动作用。

Abstract
With the rapid development of the market economy, industry monopolies have become increasingly prominent, posing a serious threat to fair competition in the market. Against this backdrop, exploring regulatory issues and countermeasures within the fr amework of antitrust law is of significant importance. This study aims to thoroughly analyze the challenges faced by industry regulation under the antitrust legal fr amework. By employing literature review methods, it examines relevant theoretical achievements both domestically and internationally, and through case analysis, it conducts an in-depth examination of typical industries. The research reveals that current industry regulation suffers from inadequacies in laws and regulations, insufficient independence of regulatory agencies, and lagging regulatory methods. In response to these issues, innovative countermeasures are proposed, including improving the legal system and refining the application rules of antitrust law in various industries; enhancing the independence of regulatory agencies and establishing a multi-department collaborative regulatory mechanism; innovating regulatory methods and utilizing modern information technologies such as big data to improve regulatory efficiency. This study not only provides insights into addressing existing problems in China’s industry regulation but also enriches the theoretical content of industry regulation under the antitrust legal fr amework, actively promoting the maintenance of fair competition order in the market and the healthy development of the market economy.
