摘 要
随着全球化进程加快和知识经济蓬勃发展，知识产权保护制度在促进创新、维护市场秩序方面发挥着不可替代的作用。本研究旨在深入剖析当前我国知识产权保护制度实施过程中存在的问题并提出针对性对策，以期为完善相关制度提供理论支持与实践指导。通过对国内外大量文献资料进行梳理总结，并结合实地调研获取的一手数据，采用定性与定量相结合的研究方法，发现我国知识产权保护存在法律法规体系不够健全导致部分领域出现监管空白；执法力度不足使得侵权成本低而维权成本高；公众意识淡薄影响整体保护氛围营造等问题。针对上述问题，本文创新性地从构建全方位多层次的法律框架出发，强化行政司法协同治理机制，同时注重宣传教育以提升全社会知识产权保护意识，形成政府主导、社会共治的良好格局，从而有效解决现存困境，推动我国知识产权保护水平迈向新高度，为创新型国家建设奠定坚实基础。

Abstract
As the process of globalization accelerates and the knowledge economy flourishes, the intellectual property rights (IPR) protection system plays an indispensable role in promoting innovation and maintaining market order. This study aims to thoroughly analyze the issues existing in the implementation of China’s IPR protection system and propose targeted countermeasures to provide theoretical support and practical guidance for improving relevant systems. By systematically reviewing a large number of domestic and international literature and combining it with primary data obtained from field research, this study employs a mixed-methods approach integrating qualitative and quantitative analysis. It identifies several critical issues in China’s IPR protection: an incomplete legal fr amework leading to regulatory gaps in certain areas; insufficient law enforcement resulting in low infringement costs and high维权 costs for rights holders; and a lack of public awareness that hampers the creation of an overall protective environment. To address these challenges, this paper innovatively proposes constructing a comprehensive multi-level legal fr amework, strengthening administrative and judicial collaborative governance mechanisms, and enhancing education and publicity to raise societal IPR protection awareness. These measures aim to form a government-led, society-wide co-governance pattern, effectively resolving existing difficulties and elevating China’s IPR protection standards to new heights, thereby laying a solid foundation for building an innovative nation.
