数据跨境流动的法律监管与隐私保护

摘 要：随着全球化和数字经济的快速发展，数据跨境流动日益频繁，给各国法律监管与隐私保护带来严峻挑战。本研究旨在探讨数据跨境流动中的法律监管与隐私保护问题，通过文献分析、案例研究等方法，深入剖析当前国际上主要国家和地区在该领域的法律法规及实践模式，对比分析其异同点。研究发现，不同国家因政治、经济、文化差异，在数据跨境流动的法律监管框架构建、隐私保护标准设定等方面存在较大差异，但也有趋同趋势，如强化个人信息主体权利、提高数据控制者义务等。本研究创新性地提出构建多元协同治理机制，强调政府、企业和社会公众共同参与，并倡导建立全球统一的数据跨境流动规则体系，以平衡数据自由流动与隐私安全保护之间的关系，为完善我国相关立法提供参考借鉴，对促进全球数字经济健康发展具有重要意义。

Abstract
With the rapid development of globalization and the digital economy, cross-border data flows have become increasingly frequent, posing significant challenges to legal regulation and privacy protection in various countries. This study aims to explore the issues of legal regulation and privacy protection in cross-border data flows by employing methods such as literature analysis and case studies, delving into the laws and practices of major countries and regions internationally. The findings reveal that due to differences in politics, economics, and culture, there are considerable variations among countries in constructing legal regulatory fr ameworks for cross-border data flows and setting privacy protection standards; however, there is also a trend towards convergence, such as enhancing the rights of personal information subjects and increasing the obligations of data controllers. Innovatively, this study proposes the establishment of a multi-stakeholder collaborative governance mechanism, emphasizing the participation of governments, enterprises, and the public, while advocating for the creation of a unified global rule system for cross-border data flows. This approach seeks to balance the relationship between data free flow and privacy security protection, providing valuable references for improving relevant legislation in China and contributing significantly to the healthy development of the global digital economy.
