摘 要
随着我国农村土地制度改革的深入推进，土地经营权流转已成为优化资源配置、促进农业现代化的重要途径。然而，现行法律体系在实践运行中仍存在诸多问题，制约了土地流转的规范化和效率提升。本研究以《农村土地承包法》及相关法规为研究对象，采用文献分析、案例研究和比较研究等方法，系统梳理了当前土地经营权流转面临的法律困境。研究发现，主要问题集中在流转主体资格认定模糊、流转程序规范性不足、纠纷解决机制不完善等方面。针对这些问题，本文创新性地提出了完善法律体系的建议：首先，明确界定流转主体的法律地位和权利义务；其次，健全流转合同的标准化范本和备案制度；再次，构建多元化的纠纷预防与解决机制。研究还特别关注了数字技术在土地流转中的应用前景，建议建立统一的土地流转信息平台。

Abstract
With the deepening of the reform of rural land system in China, the transfer of land management right has become an important way to optimize the allocation of resources and promote agricultural modernization. However, there are still many problems in the practice operation of the current legal system, which restricts the standardization and efficiency improvement of land circulation. This study takes the Rural Land Contracting Law and relevant regulations as the research ob ject, using literature analysis, case study and comparative study to systematically sort out the current legal difficulties faced by the transfer of land management rights. It is found that the main problems focus on the fuzzy qualification identification of the circulation subject, the insufficient standardization of the circulation procedure, and the imperfect dispute resolution mechanism. In view of these problems, this paper innovatively puts forward suggestions to improve the legal system: first, clearly define the legal status, rights and obligations of the circulation subject; second, improve the standardized model and filing system of circulation contract; again, build a diversified resolution and dispute prevention mechanism. The research also pays special attention to the application prospect of digital technology in land transfer, and suggests to establish a unified land transfer information platform.
