数字化时代消费者权益保护的新挑战与对策

  随着信息技术的迅猛发展,数字化时代为消费者权益保护带来了前所未有的新挑战。本研究旨在探讨数字化背景下消费者权益面临的新问题,并提出针对性的应对策略。通过文献分析、案例研究及问卷调查相结合的方法,系统梳理了当前消费者在个人信息安全、网络交易安全、数字产品服务质量等方面遭遇的主要困境。研究发现,大数据滥用、算法歧视、虚拟财产保护缺失等问题日益凸显,传统消费者权益保护框架难以适应新的需求。基于此,本文创新性地提出了构建多主体协同治理机制,强调政府监管、行业自律与消费者自我保护并重;建议完善相关法律法规,明确数字资产权属,规范数据使用规则;倡导建立透明可追溯的交易体系,保障消费者知情权和选择权。研究结果不仅为解决当前消费者权益保护难题提供了理论依据,也为相关政策制定者和企业实践者提供了具有操作性的参考方案,对推动我国数字经济健康发展具有重要现实意义。

Abstract
  With the rapid development of information technology, the digital age has presented unprecedented challenges to consumer rights protection. This study aims to explore new issues faced by consumer rights in a digital context and propose targeted strategies for addressing these challenges. By integrating literature analysis, case studies, and survey research, this paper systematically examines the primary difficulties consumers encounter in areas such as personal information security, online transaction safety, and the quality of digital products and services. The findings reveal that problems such as the misuse of big data, algorithmic discrimination, and the lack of protection for virtual property have become increasingly prominent, highlighting the inadequacy of traditional consumer rights protection fr ameworks in meeting new demands. In response, this study innovatively proposes the establishment of a multi-stakeholder collaborative governance mechanism, emphasizing the importance of government regulation, industry self-regulation, and consumer self-protection. It recommends enhancing relevant laws and regulations to clarify the ownership of digital assets and standardize data usage rules. Furthermore, it advocates for the creation of transparent and traceable transaction systems to safeguard consumers' rights to information and choice. The results not only provide theoretical support for resolving current challenges in consumer rights protection but also offer operational recommendations for policymakers and business practitioners, contributing significantly to the healthy development of China's digital economy.
