  随着互联网技术的迅猛发展,网络交易规模不断扩大,消费者权益保护面临新的挑战。本文旨在探讨消费者保护法在网络交易环境中的适用问题与对策,通过文献研究、案例分析及比较法研究等方法,系统梳理现行法律框架在网络交易场景下的局限性。研究发现,当前消费者保护法在网络交易中存在立法滞后、监管主体不明确、证据收集困难等问题,导致消费者在遭遇侵权时难以有效维权。针对上述问题,本文提出完善立法体系,明确监管部门职责,建立多元化的纠纷解决机制,强化平台责任等对策建议。创新之处在于结合我国国情,借鉴国际先进经验,构建适应网络交易特点的消费者权益保护体系,为相关立法和政策制定提供理论依据。研究成果不仅有助于弥补现有法律制度的不足,也为规范网络交易秩序,促进电子商务健康发展提供了重要参考。

Abstract 
  With the rapid development of Internet technology and the continuous expansion of online transaction scales, consumer rights protection faces new challenges. This paper aims to explore the applicability issues and countermeasures of consumer protection law in the context of online transactions. Through methods such as literature review, case analysis, and comparative legal studies, this research systematically examines the limitations of the current legal fr amework within the online transaction environment. The study finds that existing consumer protection laws exhibit legislative lag, unclear regulatory bodies, and difficulties in evidence collection, which hinder consumers from effectively safeguarding their rights when infringed upon. To address these issues, this paper proposes improving the legislative system, clarifying the responsibilities of regulatory authorities, establishing diversified dispute resolution mechanisms, and strengthening platform accountability. The innovation lies in integrating China’s national conditions with international best practices to construct a consumer rights protection system tailored to the characteristics of online transactions, thereby providing theoretical support for relevant legislation and policy-making. The research outcomes not only help:address the inadequacies of existing legal systems but also offer significant references for regulating online transaction orders and promoting the healthy development of e-commerce.
