  房地产市场作为国民经济的重要组成部分,其健康发展对社会稳定和经济繁荣具有深远意义。然而,在当前的法律监管体系中仍存在诸多盲点,影响了市场的规范运行。本研究旨在系统梳理我国房地产法律监管中的薄弱环节,通过文献分析、案例研究与比较法研究相结合的方法,深入剖析现行法律法规在土地出让、预售许可、交易登记等关键环节存在的制度漏洞及其成因。研究发现,现有法规在权属界定、合同管理、信息披露等方面存在不足,导致消费者权益保护不力、市场秩序紊乱等问题频发。针对上述问题,本文提出完善立法框架、强化行政监管、优化司法救济等多维度改进措施,建议建立统一的房地产信息平台,加强部门间协同治理,构建全链条监管机制。本研究不仅填补了国内关于房地产法律监管系统性研究的空白,还为相关政策制定提供了理论依据和实践参考,有助于推动我国房地产市场法治化进程,促进市场健康稳定发展。

Abstract 
  The real estate market, as a critical component of the national economy, plays a profound role in social stability and economic prosperity. However, numerous blind spots remain in the current legal regulatory system, which impede the standardized operation of the market. This study aims to systematically examine the weak links in China’s real estate legal regulation by integrating literature analysis, case studies, and comparative legal research. It delves into institutional loopholes and their causes in key areas such as land transfer, pre-sale permits, and transaction registration under existing laws and regulations. The findings reveal inadequacies in property rights definition, contract management, and information disclosure, leading to frequent issues like inadequate consumer protection and market disorder. In response to these challenges, this paper proposes multidimensional improvement measures, including refining the legislative fr amework, strengthening administrative supervision, and optimizing judicial remedies. It suggests establishing a unified real estate information platform, enhancing inter-departmental collaborative governance, and constructing an end-to-end regulatory mechanism. This research not only fills the gap in systematic studies on real estate legal regulation in China but also provides theoretical foundations and practical references for policy-making, thereby promoting the legalization process of China’s real estate market and fostering its healthy and stable development.
