摘 要
随着社会转型加速，婚姻家庭领域出现诸多新情况、新问题，传统法律适用面临挑战。本研究旨在系统梳理婚姻家庭法律适用中的难点并提出改进建议，通过文献分析与案例研究相结合的方法，对现行《民法典》婚姻家庭编及相关司法解释进行深入剖析。研究发现，在夫妻共同债务认定方面存在标准模糊的问题；在子女抚养权归属判定中缺乏科学评估体系；在财产分割时未能充分考虑无形资产价值；涉外婚姻案件处理机制尚不完善。针对上述问题，本文创新性地提出了构建多维度评价体系以明确夫妻共同债务范围，引入心理学和社会学专业评估机制优化子女抚养权判定流程，建立动态财产评估模型确保财产分割公平合理，并建议完善涉外婚姻登记和司法协助制度。研究成果不仅为司法实践提供了具体操作指南，也为相关立法完善提供了理论支持，有助于推动我国婚姻家庭法律制度与时俱进，更好地维护当事人合法权益，促进家庭和谐稳定。

Abstract
With the acceleration of social transformation, new situations and challenges have emerged in the domain of marriage and family, posing significant challenges to the application of traditional laws. This study aims to systematically identify the difficulties in the application of marriage and family law and propose improvement suggestions. By integrating literature analysis with case studies, this research conducts an in-depth examination of the current Marriage and Family Chapter of the Civil Code and related judicial interpretations. The findings reveal ambiguities in the criteria for identifying joint marital debts, a lack of a scientific evaluation system for determining child custody, insufficient consideration of intangible asset values during property division, and inadequacies in the mechanisms for handling transnational marriage cases. In response to these issues, this paper innovatively proposes the construction of a multi-dimensional evaluation system to clarify the scope of joint marital debts, the introduction of professional psychological and sociological assessment mechanisms to optimize the process of determining child custody, the establishment of a dynamic property valuation model to ensure fair and reasonable property division, and recommendations for improving the registration and judicial assistance systems for transnational marriages. These research outcomes not only provide specific operational guidelines for judicial practice but also offer theoretical support for legislative improvements, thereby promoting the modernization of China's marriage and family legal system, better safeguarding the legitimate rights and interests of parties involved, and fostering family harmony and stability.
