摘 要
本研究旨在探讨商标权与言论自由之间的冲突问题。在全球化背景下,商标作为企业形象和品牌价值的重要载体,其保护日益受到重视。然而,随着网络信息的迅猛发展,商标权与公众言论自由之间的界限逐渐模糊,冲突频发。本研究采用文献分析法与案例研究法,系统梳理了国内外相关法律法规及典型案例,深入剖析了商标权与言论自由冲突的表现形式、成因及其社会影响。研究发现,商标权过度保护可能限制公众对商标的合理评论与批评,进而侵犯言论自由;而言论自由的不当行使亦可能损害商标权人的合法权益。

Abstract
This study aims to explore the conflict between trademark rights and freedom of speech. In the context of globalization, trademark protection, as an important carrier of corporate image and brand value. However, with the rapid development of network information, the boundary between trademark right and public freedom of speech is gradually blurred, and conflicts occur frequently. This study adopts the literature analysis method and the case study method, systematically sorts out the relevant laws and regulations and typical cases at home and abroad, and deeply analyzes the manifestations, causes and social influence of the conflict between trademark right and freedom of speech. The study found that the excessive protection of trademark rights may restrict the public's reasonable comment and criticism of the trademark, and then infringe on the freedom of speech; and the improper exercise of freedom of speech may also damage the legitimate rights and interests of the trademark owner.
