摘 要
在我国法律体系中，立法解释的重要性不言而喻，然而实际操作中却存在立法解释虚置的现象。本研究旨在深入探讨立法解释虚置的根源，并提出相应的完善策略。通过文献分析法、案例研究及比较研究等方法，系统梳理了我国立法解释的现状与挑战。研究发现，立法解释虚置的主要原因包括解释程序不规范、解释权限不明确以及监督机制不完善等。针对这些问题，本文创新性地提出了一系列解决方案：首先，应明确立法解释的具体程序和权限，确保其在法律体系中的定位清晰；其次，建立健全的监督机制，以保障立法解释的有效执行；最后，加强立法解释的宣传与教育，提高其社会认知度和影响力。

Abstract
In China's legal system, the importance of legislative interpretation is self-evident, but there is the phenomenon of false legislative interpretation in practice. This study aims to explore the root of legislative interpretation and propose corresponding improvement strategies. Through literature analysis method, case study and comparative study, the current situation and challenges of legislative interpretation in China are systematically sorted out. The study found that the main reasons for the false legislative interpretation include the non-standard interpretation procedure, the unclear interpretation authority and the imperfect supervision mechanism. In response to these problems, this paper innovatively proposes a series of solutions: first, the specific procedures and authority of legislative interpretation should be clarified to ensure its clear positioning in the legal system; secondly, a sound supervision mechanism should be established to ensure the effective implementation of legislative interpretation; finally, the publicity and education of legislative interpretation should be strengthened to improve its social awareness and influence.
