摘 要
本研究通过对刑事被害人权利保护法律问题的深入探究，旨在揭示当前刑事司法体系中被害人权利保障的现状及其所面临的挑战。明确了刑事被害人权利保护的定义和范围，包括诉讼权利、赔偿与补偿权等方面，并阐述了其理论依据，如正义理论与人权理念。在此基础上，进一步分析了刑事被害人权利保护的法律原则，包括平等保护、全面保护、及时保护以及尊重和保障人权等。研究指出，当前刑事被害人权利保护存在诸多法律问题，如权利保障不充分、赔偿机制不完善、法律援助缺失以及司法程序忽视被害人权益等。这些问题不仅影响了被害人的合法权益，也制约了刑事司法体系的公正与效率。针对这些问题，提出了相应的法律对策，包括完善法律规定、建立健全赔偿机制、加强法律援助制度以及强化司法程序中被害人权益保障等。这些对策旨在提升刑事被害人权利保护的法律效果，促进刑事司法体系的公正、公平和高效运行。本研究通过深入剖析刑事被害人权利保护的法律问题及其对策，旨在推动刑事司法体系不断完善，更好地保障被害人的合法权益。

Abstract
This study aims to reveal the current situation of victim rights protection in the criminal justice system. The definition and scope of the rights protection of criminal victims, including litigation rights, compensation and compensation rights, and its theoretical basis, such as the theory of justice and the concept of human rights, are expounded. On this basis, the legal principles of the rights protection of criminal victims are further analyzed, including equal protection, comprehensive protection, timely protection and respect and protection of human rights. The research points out that there are many legal problems in the protection of the rights of criminal victims, such as insufficient protection of rights, imperfect compensation mechanism, lack of legal aid and the neglect of the rights and interests of victims in judicial procedures. These problems not only affect the legitimate rights and interests of the victims, but also restrict the fairness and efficiency of the criminal justice system. In view of these problems, the corresponding legal countermeasures are put forward, including improving the legal provisions, establishing and perfecting the compensation mechanism, strengthening the legal aid system and strengthening the protection of the victims' rights and interests in the judicial procedure. These countermeasures aim to enhance the legal effect of the protection of criminal victims' rights and promote the fair, fair and efficient operation of the criminal justice system. By analyzing the legal problems of the rights protection of criminal victims, this study aims to promote the continuous improvement of the criminal justice system and better protect the legitimate rights and interests of victims.

Abstract
