家庭暴力情形下夫妻共同财产的分割研究
本文旨在探讨家庭暴力情形下夫妻共同财产的分割问题。随着家庭暴力事件的频发，如何在保障受害者权益的同时，实现夫妻共同财产的公正分割，成为法律界和社会关注的焦点。本文分析了家庭暴力的定义、表现形式及其对夫妻共同财产的影响。家庭暴力不仅侵犯了受害者的身心健康，还可能导致其无法正常工作或参与财产管理，从而影响其在财产分割中的权益，本文探讨了夫妻共同财产分割的难点。证据收集的困难、财产评估的复杂性、子女权益保护的挑战以及司法实践的困境等问题，使得家庭暴力情形下的财产分割变得更加复杂和敏感。针对以上问题，本文提出了相应的解决策略。建议建立专门的家暴证据收集机制，提高法律意识和证据意识；制定统一的财产评估标准，考虑家暴对财产价值的影响；加强子女权益保护，确保其在财产分割中得到充分考虑；加强法官培训，完善法律解释和适用，推动跨部门合作。本文强调了在家庭暴力情形下，保障受害者权益的重要性。通过完善相关法律法规和司法实践，实现夫妻共同财产的公正分割，有助于维护家庭和谐稳定，促进社会公平正义。

Abstract
This paper aims to discuss the division of joint property in the case of domestic violence. With the frequent occurrence of domestic violence, how to realize the fair division of the joint property while protecting the rights and interests of the victims has become the focus of the legal community and the society. This article analyzes the definition and ex pression of domestic violence and its influence on the joint property. Domestic violence not only infringes on the physical and mental health of the victims, but also may lead to their inability to work normally or participate in the property management, thus affecting their rights and interests in the property division. This paper discusses the difficulties of the joint property division of the couple. The difficulty of evidence collection, the complexity of property assessment, the challenge of the protection of children's rights and interests, and the dilemma of judicial practice make the division of property in the case of domestic violence more complex and sensitive. In view of the above problems, this paper proposes the corresponding solution strategy. It is suggested to establish a special evidence collection mechanism for domestic violence, to improve legal awareness and evidence awareness, formulate unified property assessment standards, consider the impact of domestic violence on property value; strengthen the protection of children's rights and interests to ensure full consideration in the division of property; strengthen the training of judges, improve legal interpretation and application, and promote cross-departmental cooperation. This paper emphasizes the importance of protecting the rights of victims in the context of domestic violence. Through the improvement of relevant laws and regulations and judicial practice, to achieve the fair division of the common property of husband and wife, to help to maintain family harmony and stability, and promote social fairness and justice.
