摘 要
本篇论文通过对现代经济法产生的历史背景、体现和现代性思考的探讨，就现代经济法的概念及其具体体现进行了详细阐述。在市场失效和政府失效的基础上，近代经济法的兴起和政府的介入加速了现代经济法的产生。现代经济法的精神追求是以公平、公正、效率和可预见性为核心价值观。从历史角度看，现代经济法体现了逻辑严谨、科学合理和规范先进的品质。从制度建设角度看，其现代性体现在经济法的定位、职能、目标和实践中。尽管我国的经济法制建设取得了显著成就，但古代经济法的真实性和现代性与后现代性的辨析仍然需要深入探讨。因此，进一步推进我国的经济法制建设，加强现代性思考，注重制度创新和完善，是现代经济法发展的重要任务。

Abstract
This paper discusses the historical background, embodiment and modernity thinking of modern economic law, and expounds the concept and concrete embodiment of modern economic law in detail. On the basis of market failure and government failure, the emergence of modern economic law and government intervention accelerated the emergence of modern economic law. The spiritual pursuit of modern economic law takes fairness, justice, efficiency and predictability as the core values. From the historical point of view, modern economic law embodies the quality of rigorous logic, scientific rationality and advanced norms. From the perspective of system construction, its modernization is embodied in the orientation, function, goal and practice of economic law. Although the construction of our economic legal system has made remarkable achievements, the authenticity of ancient economic law and the discrimination between modernity and post-modernity still need to be further discussed. Therefore, it is an important task for the development of modern economic law to further promote the construction of economic law, strengthen the thinking of modernity, and pay attention to the innovation and perfection of system.
