著作权法中的版权继承与遗赠问题研究
摘 要
随着信息技术的迅猛发展，著作权保护面临新的挑战，版权继承与遗赠问题愈发复杂。本研究聚焦于著作权法中的版权继承与遗赠，旨在深入剖析现行法律框架下相关制度的适用性及存在的问题。通过对国内外大量案例进行系统梳理，并结合法学理论分析，探讨了版权继承与遗赠在主体资格、客体范围、权利行使等方面的具体规定。研究发现，当前我国版权继承与遗赠制度存在立法滞后、操作性不强等问题，特别是在数字环境下，传统规则难以适应新兴需求。

Abstract
With the rapid development of information technology, copyright protection is facing new challenges, and the problems of copyright inheritance and legacy are becoming more and more complex. This study focuses on the inheritance and legacy of copyright in the copyright law, and aims to deeply analyze the applicability and existing problems of the relevant systems under the current legal fr amework. By systematically combing a large number of cases at home and abroad, and combining with the analysis of legal theory, the specific provisions of copyright inheritance and legacy in the aspects of subject qualification, ob ject scope and the exercise of rights are discussed. It is found that there are some problems of copyright inheritance and legacy system in China, such as lagging legislation and weak operability, especially in the digital environment, the traditional rules are difficult to adapt to the emerging needs.
