网络著作权保护中的“独创性”认定标准研究 -法学专业

摘要

随着互联网技术的迅猛发展，网络环境下的作品创作与传播呈现出前所未有的特点，著作权保护面临诸多新挑战，其中“独创性”认定标准在网络著作权保护中的适用问题尤为突出。本研究旨在探讨网络环境下著作权保护中“独创性”的认定标准，以期为相关立法完善和司法实践提供理论支持。通过对国内外关于“独创性”认定标准的文献进行梳理，结合网络作品的特点，采用比较分析、案例分析等方法，深入剖析现行认定标准在网络环境下面临的问题。研究发现，传统“独创性”认定标准在面对网络作品时存在一定的滞后性和局限性，难以适应网络作品快速更迭、交互性强等特点。创新点在于提出构建符合网络作品特性的“独创性”认定标准体系，该体系应综合考虑创作过程、表达形式、用户参与度等多方面因素，区别于传统作品的认定标准。主要贡献是为网络著作权保护提供了新的视角和思路，有助于推动我国网络著作权保护制度的健全与发展，对规范网络创作秩序、促进网络文化产业健康发展具有重要意义。

Abstract

With the rapid development of Internet technology, the creation and dissemination of works in a network environment exhibit unprecedented characteristics, posing numerous new challenges to copyright protection. Among these challenges, the application of the "originality" criterion in online copyright protection stands out as particularly significant. This study aims to explore the criteria for determining "originality" in copyright protection within a network environment, providing theoretical support for relevant legislative improvements and judicial practices. By reviewing literature on the criteria for determining "originality" both domestically and internationally, and combining this with the characteristics of online works, this research employs comparative analysis and case analysis to delve into the issues faced by current criteria in a network setting. The findings indicate that traditional "originality" criteria exhibit certain lagging and limitations when applied to online works, struggling to adapt to the rapid updates and strong interactivity of such content. An innovation of this study lies in proposing the construction of an "originality" determination system tailored to the characteristics of online works, which should comprehensively consider factors such as the creative process, forms of ex pression, and user participation, distinguishing it from the criteria for traditional works. The primary contribution is offering new perspectives and ideas for online copyright protection, contributing to the improvement and development of China’s online copyright protection system, and playing a crucial role in standardizing online creation order and promoting the healthy development of the online cultural industry.
