网络短视频著作权保护的法律挑战与应对
摘 要
随着网络短视频产业的迅猛发展，其著作权保护面临诸多前所未有的挑战。本研究旨在探讨网络短视频著作权保护面临的法律困境并提出应对策略。通过对国内外相关法律法规、司法案例及行业规范进行系统梳理与比较分析，结合对短视频平台运营模式、用户行为特征的研究，发现当前存在版权归属界定模糊、侵权认定标准不统一、维权成本高昂等突出问题。创新性地提出了构建适应短视频特点的“微版权”保护体系，建议完善平台责任机制，建立快速维权通道，并探索区块链等新兴技术在版权管理中的应用。研究结果表明，通过优化现有法律框架，强化平台自律，推动技术创新，能够有效提升网络短视频著作权保护水平，促进产业健康发展。

Abstract
With the rapid development of the network short video industry, its copyright protection faces many unprecedented challenges. This study aims to explore the legal dilemma of copyright protection of network short video and propose countermeasures. Through the systematic combing and comparative analysis of relevant laws and regulations, judicial cases and industry norms at home and abroad, combined with the research on the operation mode of short video platform and user behavior characteristics of short video platforms, it is found that there are prominent problems such as fuzzy definition of copyright ownership, inconsistent infringement identification standards, and high cost of rights protection. It innovatively puts forward the construction of a "micro-copyright" protection system adapted to the characteristics of short videos, and suggests to improve the platform responsibility mechanism, establish a fast rights protection channel, and explore the application of emerging technologies such as blockchain in copyright management. The research results show that by optimizing the existing legal fr amework, strengthening the platform self-discipline and promoting technological innovation, the copyright protection level of network short video can be effectively improved and the healthy development of the industry can be promoted.
