数字时代著作权公示法律问题与完善
摘 要
数字时代著作权公示面临诸多挑战，随着信息技术迅猛发展，作品传播途径日益多样化，传统著作权公示制度难以适应新的需求。本研究旨在探讨数字时代著作权公示存在的法律问题并寻求完善路径，以期保障权利人合法权益，促进作品传播与创新。通过文献研究法梳理国内外相关理论成果，运用比较分析法考察不同国家地区在数字时代著作权公示方面的立法实践，结合案例分析法深入剖析我国现行制度下出现的问题。研究发现，当前我国数字时代著作权公示存在公示内容不明确、公示方式单一且效率低下、公示效力缺乏统一标准等问题。针对上述问题提出构建多元化的公示平台，整合线上线下资源；优化公示流程，简化手续，提高公示效率；建立统一的公示效力认定规则等建议。

Abstract
Copyright publicity in the digital era faces many challenges. With the rapid development of information technology, the dissemination channels of works are increasingly diversified, and the traditional copyright publicity system is difficult to meet the new needs. The purpose of this study is to explore the legal problems existing in copyright publicity in the digital age and seek improvement, so as to protect the legitimate rights and interests of right holders and promote the dissemination and innovation of works. Through the literature research method, the relevant theoretical achievements at home and abroad are reviewed, the comparative analysis method is used to investigate the legislative practice of copyright publicity in different countries and regions in the digital age, and the problems under the current system in China are deeply analyzed combined with the case analysis method. It is found that there are some problems in the digital era of China, such as unclear content, single way and low efficiency, and lack of unified standards for publicity effectiveness. In view of the above problems, it is proposed to build a diversified publicity platform, integrate online and offline resources, optimize the publicity process, simplify procedures, improve the efficiency of publicity, and establish unified rules for the identification of publicity effectiveness.
