摘要
民事诉讼中的举证责任倒置制度作为现代证据法的重要组成部分，其适用不仅影响着司法效率，更关乎当事人权益的保障。本文基于我国现行法律框架，结合域外立法经验，深入探讨举证责任倒置制度的理论基础、适用条件及实践效果。通过对大量司法案例的实证分析，揭示当前制度运行中存在的问题，如适用范围模糊、法官自由裁量权过大等，并提出针对性改进建议。研究发现，在特定类型案件中适当扩大举证责任倒置的适用范围，有助于实现程序正义与实体正义的统一。本文创新性地构建了“三阶递进式”适用模型，即从法定要件审查、事实推定判断到最终责任分配的系统化流程，为司法实践提供了可操作性强的指引。该模型强调以实质公平为导向，兼顾诉讼效率与证明成本，确保在个案中实现公正裁判。研究成果对完善我国民事诉讼证据规则体系具有重要参考价值，为相关立法修订提供了理论支持，也为司法实务工作者处理复杂案件提供了新的思路和方法。

Abstract
The reversal of burden of proof in civil litigation, as an integral component of modern evidence law, not only influences judicial efficiency but also concerns the protection of parties' rights and interests. Based on China's current legal fr amework and drawing upon international legislative experiences, this study delves into the theoretical foundations, application conditions, and practical effects of the reversal of burden of proof. Through empirical analysis of numerous judicial cases, it uncovers existing issues in the current system, such as ambiguous scope of application and excessive judicial discretion, and proposes targeted improvement suggestions. The research finds that appropriately expanding the scope of the reversal of burden of proof in specific types of cases can help achieve unity between procedural and substantive justice. Innovatively, a "three-stage progressive" application model is constructed, which systematically progresses from statutory requirement review, factual presumption judgment to final responsibility allocation, providing a highly operational guide for judicial practice. This model emphasizes substantial fairness while balancing litigation efficiency and proof costs, ensuring fair adjudication in individual cases. The findings are of significant reference value for improving China’s civil litigation evidence rule system, providing theoretical support for relevant legislative revisions, and offering new approaches and methods for judicial practitioners handling complex cases.
