摘要
随着我国城市化进程的加快,物业服务合同在居民生活中的重要性日益凸显,《民法典》对物业服务合同的规定为研究提供了新的法律框架。本研究旨在探讨《民法典》中物业服务合同的法律性质与责任承担,通过文献分析、案例研究和比较法研究等方法,深入剖析物业服务合同的内涵、特征及其法律责任。研究发现,《民法典》明确了物业服务合同属于有名合同,并规定了物业服务人的主要义务,如按照约定和物业的使用性质提供服务、定期报告工作情况等,同时强调业主应履行按时支付物业费等义务。创新之处在于揭示了物业服务合同兼具委托合同与承揽合同的双重属性,这有助于更准确地界定双方的权利义务关系。此外,针对实践中存在的物业服务纠纷,本研究提出应根据过错原则确定责任承担方式,即物业服务人未履行或不完全履行合同时,应依据其过错程度承担相应责任;而业主若违反合同约定也需承担相应责任。这一研究成果不仅丰富了我国合同法学理论,而且为司法实践处理相关纠纷提供了有益参考,对于促进物业服务行业健康发展具有重要意义。

Abstract
With the acceleration of urbanization in China, property service contracts have become increasingly significant in residents' daily lives. The Civil Code provides a new legal fr amework for studying property service contracts. This research aims to explore the legal nature and liability of property service contracts as stipulated in the Civil Code. By employing methods such as literature analysis, case studies, and comparative law research, this study delves into the connotations, characteristics, and legal liabilities of property service contracts. It is found that the Civil Code explicitly categorizes property service contracts as named contracts and specifies the primary obligations of property service providers, including providing services in accordance with agreements and the nature of property use, as well as regularly reporting on work progress. Meanwhile, it emphasizes the obligation of owners to pay property fees on time. An innovative aspect of this research lies in revealing the dual attributes of property service contracts, which possess features of both mandate contracts and contracts for work and services, thereby facilitating a more precise definition of the rights and obligations of both parties. Furthermore, addressing the disputes arising from property services in practice, this study proposes that liability should be determined based on the principle of fault, meaning that property service providers shall bear corresponding responsibilities according to the degree of their failure or incomplete performance of contractual obligations, while owners who breach the contract also need to assume relevant responsibilities. This research not only enriches the theoretical fr amework of contract law in China but also offers valuable references for judicial practices in resolving related disputes, contributing significantly to the healthy development of the property service industry.
