摘 要
随着社会经济的发展和婚姻观念的变化，离婚率逐年上升，婚前财产在离婚案件中的界定与保护问题日益凸显。本研究旨在探讨我国现行法律框架下婚前财产的界定标准、保护机制及其在司法实践中的应用效果。通过对我国《婚姻法》及相关司法解释进行深入解读，并结合实际案例分析，采用文献研究法、比较分析法及实证研究法，系统梳理了婚前财产的范围、形式以及在婚后可能发生的转化情形。研究发现，当前我国婚前财产界定存在法律规定不够细化、部分概念模糊等问题，在实际操作中容易引发争议。创新之处在于提出构建婚前财产登记制度，明确婚前财产协议效力，完善证据规则等建议，为解决婚前财产纠纷提供新的思路。本研究不仅丰富了婚姻家庭法学理论，也为司法实践提供了可操作性的参考依据，有助于维护当事人合法权益，促进社会和谐稳定。

Abstract
With the development of social economy and the evolution of marital concepts, divorce rates have been rising annually, making the definition and protection of pre-marital property in divorce cases increasingly prominent. This study aims to explore the criteria for defining and mechanisms for protecting pre-marital property under China's current legal fr amework, as well as their application effects in judicial practice. Through an in-depth interpretation of China’s Marriage Law and relevant judicial interpretations, combined with case analysis, this research employs literature review, comparative analysis, and empirical research methods to systematically examine the scope, forms, and potential transformations of pre-marital property after marriage. The findings indicate that the current definitions of pre-marital property in China lack sufficient detail and clarity in certain concepts, leading to disputes in practical operations. Innovatively, this study proposes establishing a pre-marital property registration system, clarifying the validity of pre-marital property agreements, and improving evidence rules, offering new perspectives for resolving pre-marital property disputes. This research not only enriches the theoretical fr amework of matrimonial and family law but also provides operational references for judicial practice, contributing to the protection of parties' legitimate rights and interests and promoting social harmony and stability.

Abstract
