摘 要
食品安全法律监管是保障公众健康、维护社会稳定的重要环节，随着食品产业全球化和新兴技术的应用，传统监管模式面临诸多挑战。本文旨在分析当前食品安全法律监管中存在的问题并提出针对性对策，通过文献研究法、案例分析法及比较研究法，系统梳理国内外食品安全法律监管体系，剖析我国现行法律法规在执行层面存在的漏洞与不足，如多部门分段监管导致的衔接不畅、处罚力度不够、标准体系不完善等。研究发现，现有监管机制难以适应快速发展的食品行业需求，且消费者权益保护存在滞后性。基于此，本文创新性地提出构建以风险评估为基础、全程追溯为手段、社会共治为目标的新型监管框架，强调加强立法顶层设计，优化跨部门协同机制，提升违法成本，并引入区块链等新技术实现透明化管理。该研究不仅为完善我国食品安全法律监管体系提供了理论支持，也为全球食品安全治理贡献了中国智慧，对推动食品安全领域法治化进程具有重要现实意义。

Abstract
Food safety legal supervision is a critical component in safeguarding public health and maintaining social stability. With the globalization of the food industry and the application of emerging technologies, traditional regulatory models face numerous challenges. This study aims to analyze existing problems in current food safety legal supervision and propose targeted countermeasures. Through literature review, case analysis, and comparative studies, this paper systematically examines domestic and international food safety legal supervision systems, dissecting the loopholes and inadequacies in China's current laws and regulations at the implementation level, such as poor coordination due to segmented supervision by multiple departments, insufficient penalties, and an incomplete standards system. The research reveals that the existing regulatory mechanisms struggle to meet the rapidly evolving demands of the food industry, and consumer rights protection lags behind. Based on these findings, this paper innovatively proposes a new regulatory fr amework grounded in risk assessment, employing full-process traceability as a means and aiming for societal co-governance. It emphasizes strengthening top-level legislative design, optimizing cross-departmental collaboration mechanisms, increasing the cost of violations, and introducing new technologies like blockchain for transparent management. This research not only provides theoretical support for improving China's food safety legal supervision system but also contributes Chinese wisdom to global food safety governance, significantly advancing the rule of law in the field of food safety.
