劳动法律执行中的常见问题及解决策略

  随着市场经济的发展和劳动关系的日益复杂化,劳动法律执行面临诸多挑战。本研究旨在深入剖析当前我国劳动法律执行中的常见问题并提出切实可行的解决策略,以期为构建和谐劳动关系提供理论支持与实践指导。通过对相关法律法规文本的系统梳理,结合对全国范围内多个典型地区劳动争议案件的大数据分析以及对劳动监察部门、企业代表、劳动者三方的深度访谈,发现主要存在劳动法律法规宣传不到位导致认知偏差、劳动监察执法力量薄弱且专业化程度不足、劳动争议处理机制衔接不畅等问题。针对上述问题,创新性地提出强化劳动法律法规普及教育,建立多元化、专业化的劳动监察队伍,优化劳动争议处理流程,加强各部门间协作联动等解决策略,这些策略不仅有助于提升劳动法律执行效能,还为完善我国劳动法律体系提供了新思路,在理论层面丰富了劳动法学研究内容,在实践层面为劳动监管部门、企业及劳动者提供了有益参考。

Abstract 
  With the development of the market economy and the increasing complexity of labor relations, the enforcement of labor laws faces numerous challenges. This study aims to thoroughly analyze common issues in the current enforcement of labor laws in China and propose practical solutions to provide theoretical support and practical guidance for building harmonious labor relations. By systematically reviewing relevant legal texts, analyzing big data from labor dispute cases across multiple typical regions nationwide, and conducting in-depth interviews with representatives from labor inspection departments, enterprises, and workers, this research identifies major problems such as inadequate promotion of labor laws leading to cognitive biases, insufficient strength and professionalization of labor inspection enforcement, and poor coordination in labor dispute resolution mechanisms. In response to these issues, innovative strategies are proposed, including strengthening the dissemination and education of labor laws, establishing a diversified and specialized labor inspection team, optimizing labor dispute resolution procedures, and enhancing interdepartmental collaboration. These strategies not only contribute to improving the effectiveness of labor law enforcement but also offer new perspectives for refining China’s labor legal system. On a theoretical level, they enrich the content of labor law studies, while on a practical level, they provide valuable references for labor regulatory authorities, enterprises, and workers.
