摘 要
随着市场经济的快速发展，反垄断法律制度在维护市场公平竞争方面发挥着不可替代的作用，但其实施过程中面临诸多难点。为深入剖析这些难点并探寻有效对策，本研究基于国内外相关理论与实践案例，综合运用文献分析、比较研究等方法展开探讨。研究发现，在执法主体方面存在多头执法、协调机制不健全等问题，导致执法效率低下；从执法对象看，新兴行业垄断行为隐蔽性强、界定困难，传统行业则存在地方保护主义干扰正常执法。针对上述问题，提出构建统一高效的反垄断执法机构，强化部门间协作配合；完善相关法律法规，明确新兴领域垄断行为认定标准，加强国际交流合作借鉴先进经验。同时，强调提高社会公众对反垄断法的认知度和支持度，形成全社会共同参与的良好氛围，以确保反垄断法律制度的有效实施，这不仅有助于解决当前面临的困境，更为我国建立更加完善的社会主义市场经济体制提供了有力保障，本研究创新性地将新兴行业纳入考察范围，为后续研究提供新视角。

Abstract
With the rapid development of the market economy, antitrust legal systems play an indispensable role in maintaining fair competition. However, numerous challenges arise during their implementation. To thoroughly analyze these challenges and explore effective solutions, this study employs a comprehensive approach based on domestic and international theories and practical cases, utilizing methods such as literature analysis and comparative studies. The research reveals that issues such as multiple enforcement entities and inadequate coordination mechanisms lead to low enforcement efficiency. From the perspective of enforcement targets, monopolistic behaviors in emerging industries are characterized by strong concealment and difficulty in definition, while traditional industries suffer from local protectionism that interferes with normal law enforcement. In response to these problems, it is proposed to establish a unified and efficient antitrust enforcement agency to strengthen inter-departmental cooperation. Relevant laws and regulations should be improved to clarify the criteria for identifying monopolistic behaviors in emerging fields, and international exchanges and cooperation should be enhanced to draw on advanced experiences. Additionally, it emphasizes the importance of increasing public awareness and support for antitrust laws to foster a positive atmosphere of societal participation, ensuring the effective implementation of antitrust legal systems. This not only helps address current challenges but also provides a robust guarantee for establishing a more complete socialist market economy system in China. Innovatively, this study incorporates emerging industries into its scope of examination, offering new perspectives for future research.
