摘 要
租赁合同作为现代社会经济交往中极为常见的契约形式,承租人权益的保护成为民法研究的重要课题。随着市场经济的发展和人们法律意识的提高,传统民法对承租人权益保护存在诸多不足,如在租赁物瑕疵担保、优先购买权等方面规定不够完善,这便是本论文的研究背景。本研究旨在深入探讨现行民法框架下租赁合同中承租人权益保护机制,通过文献研究法梳理国内外相关理论成果与立法实践,结合案例分析法剖析具体司法判例以发现现有保护机制存在的问题并提出优化建议。研究结果表明,当前我国民法虽构建了一定程度上的承租人权益保护体系,但仍有改进空间,例如应进一步明确出租人交付合格租赁物的责任、细化优先购买权行使条件等。

Abstract
As a very common form of contract in modern social and economic communication, the protection of lessee's rights and interests has become an important subject of civil law research. With the development of market economy and the improvement of people's legal awareness, there are many deficiencies in the protection of lessees' rights and interests, such as the imperfect guarantee of defects in the lease, preemptive right and other aspects, which is the research background of this paper. The purpose of this study is to deeply explore the protection mechanism of lessees' rights and interests in the lease contract under the current fr amework of civil law, sort out relevant theoretical achievements and legislative practices at home and abroad through literature research method, analyze specific judicial cases combined with case analysis method to find the problems existing in the existing protection mechanism and put forward optimization suggestions. The results show that although the civil law in China has built a protection system of lessees' rights and interests to a certain extent, there is still room for improvement. For example, for example, the responsibility of the lessor to deliver the qualified lease item should be further clarified, and the conditions for the exercise of preemptive right should be refined.
